PAY-PER-CALL ANSWERS

What are the TCPA consent basics for lead buyers?

Updated October 8, 2026 · By the LiveWireCalls team

IN BRIEF

The short answer

The Telephone Consumer Protection Act (TCPA) limits marketing calls and texts to consumers, especially calls made with automated dialing systems or prerecorded or artificial voices, and calls to numbers on Do Not Call lists. Buyers who follow up on leads by phone or text should be able to show documented consent for that contact. This page is general information, not legal advice.

  • Consumer-initiated inbound calls are different from outbound follow-up.
  • Outbound marketing calls and texts to leads generally need documented consent.
  • Keep proof of consent, such as the form, disclosure text and timestamp.
  • State laws can add stricter rules. Get advice from a qualified attorney.

Inbound calls vs outbound follow-up

When a consumer chooses to call a business, that call is consumer-initiated. Consent questions usually arise when a business calls or texts a consumer, for example following up on a web form, retrying a missed call or sending reminders. Each of those outbound contacts needs to be covered by the consent the consumer gave.

What buyers usually ask for

  • The exact disclosure language shown next to the submit button
  • The page URL and a timestamp of the submission
  • A third-party consent certificate or session record where used
  • The name of the business the consumer agreed to hear from
  • How opt-outs are honored across calls and texts

Rules change

Federal rules and their interpretation have changed several times in recent years, and several states have their own telemarketing laws. Review current FCC guidance and get advice from an attorney who handles telemarketing law before launching outbound programs.

QUESTIONS

Common questions.

01Does an inbound call need TCPA consent?+

A call the consumer places is not an outbound marketing call. Any later outbound calls or texts to that consumer should be covered by appropriate consent.

02Is this legal advice?+

No. It is general information. Speak with a qualified attorney about your own programs.
